Terms & Conditions of Sale
Order Conditions: All orders received are subject to availability and crop conditions. All orders shall be void should injury befall our nursery stock from frost, hail, flood, fire or other causes beyond our control.
Shipping: To ship via a carrier it is very important that we receive a street address and any other specific shipping instructions.
Liability for claims arising from delays or damage in transit rests solely with the carrier, but we will be pleased to assist with claims of this nature.
Pickup: It is the customer’s responsibility to protect the plants from frost, heat and wind damage during transportation. Pickup date and time must be arranged in advance.
Payment: We require new customers to pay their first order in full upon pickup. Cash, certified cheque, money order, VISA, and Mastercard are accepted methods of payment.
Invoices are net 30 days for customers with established credit and who have a good credit rating with Verbinnen’s Nursery Ltd.. After 30 days an interest charge will apply for outstanding invoices. Credit applications are available upon request.
All other taxes, duties and brokerage charges are the responsibility of the customer.
Guarantee: If any nursery stock proves untrue to the description or variety name under which it is sold, Verbinnen’s Nursery Ltd. will upon proper proof replace such nursery stock or refund the original amount paid. Verbinnen’s Nursery Ltd. shall in no case be liable for any sum greater than the amount paid.
Claims: All claims must be reported within 5 days of receiving goods.
Returns: Nursery stock cannot be returned without the express permission of John Verbinnen. In all cases, goods cannot be returned if they have been improperly stored, treated, damaged, or modified in any way.
Agreement: All nursery stock sold by Verbinnen’s Nursery Ltd. and accepted by the purchaser verifies that all conditions of sale are accepted and understood by the purchaser to be binding.
